These terms and conditions govern your subscription agreement. Please read them carefully. We are passionate about carbon offset products, and we want to make sure you understand so you will share them with your friends and relatives.

I. Who We Are
Our Company. ReBalance is a trademark of Solomon Community Solar LLC. Since 2018, Solomon Community Solar has helped residential households and small businesses offset their carbon emissions by supporting solar farms. Today these farms produce over 360 billion watts per year of electricity from the sun, reducing the utility bills and offsetting the carbon footprint of over 38,000 customers in New York, Maine, New Jersey, Massachusetts, and Illinois.
Our Goals. Americans on average account for some 20 tons of carbon dioxide emissions equivalent annually: 20 tons! These emissions stay in our atmosphere and have a direct impact on our climate. ReBalance believes in reducing our economy’s dependence on carbon-based fuels. ReBalance customers are helping to increase the amount of solar, wind, biofuel, and hydro-electric generation as well as plant large forests and methane capture technologies that absorb carbon dioxide. Together we can have a meaningful impact on climate change.
Definitions. ReBalance refers to our company and to our website where our carbon offset products are available for subscription. When we say “we,” “our” or “us” we refer to ReBalance and when we refer to “you” or “your” we refer to the customer of our products and services. “ReBalance products” are subscription products or services offered on its website by ReBalance. “Clean energy projects” include solar, wind, and hydro-electric generation projects as well as forestry projects and methane capture technologies that absorb carbon dioxide.

You may have questions about ReBalance products or how you can purchase a gift for a friend. III. Our Services
You may subscribe to ReBalance products by filling out our online form or by calling our passionate Customer Care Representatives.
Carbon Offsets. When you subscribe to ReBalance products, you are authorizing us to offset your carbon footprint with certificated clean energy projects that produce clean, carbon-free energy or absorb carbon-dioxide.
What We Do. You tell us how much of your carbon footprint you wish to offset. We then invest in clean energy projects.
Our Quality Standards. We only invest in clean energy projects that can demonstrate to us that they are new projects and that the certificated carbon offsets we buy are retired, that is, that they are not used more than once, thereby offsetting the carbon dioxide emissions of traditional forms of carbon-fueled electricity generation such as coal, natural gas, and fuel oil power plants.
IV. Clean Energy Projects
We look for clean energy projects that meet our standards and put pictures of those projects on our website. All our projects provide certificates from national groups that track clean energy projects. Sometimes pictures of a specific project are unavailable, and we use a generic picture of a similar project such as a solar farm or an offshore wind project. We aim to keep our website up to date; however, there may be delays in when we post names and pictures of these projects.
V. Carbon Offset Calculations
Your Carbon Footprint. Your carbon footprint is determined by your lifestyle: Such things as the size of your house and the type of fuel you use to heat and cool it; the type of cars you drive and the miles you drive each year; the number of airline flights you take each year; and the types of food you and your family consume.
How Do We Measure Your Carbon Footprint? Obviously, it would be annoying and intrusive for us to try to measure everything you do on a daily basis. Accordingly, we estimate your carbon footprint based on broad categories that are found on our website: Size of your family, number of cars, type of heat used. We base these categories on averages drawn from publicly available demographic statistics. We then make assumptions on the amount of carbon dioxide emissions these broad categories generate.
Good Faith Estimates. We do our best to make a good faith estimate of your carbon footprint. But we can’t be precise. In buying ReBalance products and services you acknowledge that these assumptions are approximate and may not be fully accurate.
Clean Power Offsets. We also make estimates about the carbon offset potential of different projects. When we invest in carbon offsets that are generated through clean energy electricity production, the amount of metric tons of carbon offset can be calculated with a high level of accuracy based on the mix of carbon-based fuels used to make electricity in your region.
Forestry Offsets. When we purchase certificated forestry projects the number of tons of carbon dioxide that is absorbed each year is a function of the species of tree as well as its latitude. Those numbers are more difficult to gauge. We rely upon the estimates of metric tons equivalent that we receive from the national groups referred to above.
VI. Gifts
In addition to offsetting your own carbon footprint, you can give “the gift of Green” by investing in carbon offsets for a friend or relative. When you subscribe to Rebalance as a gift, we rely on your estimates of how many metric tons of carbon dioxide your friend or relative accounts for each year. We rely on that estimate when we process your gift.
We do not want to represent that your gift provides enough offsets to balance the entire carbon footprint of your friend or relative. When we acknowledge your gift with a certificate, we will make it clear that your gift represents the estimated percentage of the recipient’s carbon footprint.
VII. Term; Cancel Any Time Without Penalty
Month-to-Month. We are grateful that you have chosen to help expand the number of renewable energy projects that offset our extensive carbon footprint. Our clean energy projects produce electricity or absorb carbon every day of the year. However, we understand that you and our other customers want to preserve their flexibility. Therefore, your subscription is for carbon offsets for one month only. At the end of every month, we automatically renew your subscription of carbon offsets for another month only.
Termination. You may terminate this subscription agreement at any time without penalty, effective immediately. You can terminate by going online to the ReBalance website and filling out the termination form, by contacting us by email, or by calling our customer call center at the number indicated above. Because we have invested in an entire month of carbon offsets on your behalf, we cannot refund to you a partial or pro rata amount after your termination.
VIII. Payments
Choose Your Payment Method. You may pay by credit card or ACH payment, as you choose at the time of subscription. You may provide this information online or by phone to our call center representatives.
Bank-Quality Security. We do not store your credit cards or bank information. If you fill out information on our website it goes to our secure, third-party payment processing company; we do not save it. If you give us this information by phone, we do not record any part of the phone call that includes the payment information. Our third-party payment processing company is compliant with the Standards established by the Payment Card Industry (PCI) Security Council. PCI standards protect your data from security breaches and from the theft of your payment information.
Your Payment Amount. When you subscribe to ReBalance, you select the amount of your carbon offsets and their monthly cost. Because we invest in clean energy projects on your behalf immediately upon receiving your order, your monthly payment is non-refundable. Each month following your subscription we will charge your designated payment method for another month of carbon offsets. Your payments will continue unless and until you cancel your subscription. Because the price of renewable energy is volatile, the amount of carbon offsets purchased on your behalf may be adjusted based on your payment amount.
IX. Liability
Neither you nor we shall be responsible to each other for any indirect or consequential losses that occur in connection with ReBalance subscriptions, whether arising from negligence or otherwise. Your liability to us shall never be greater than the price of your subscription. Our liability to you shall never be greater than the cumulative price you paid for ReBalance products.
X. Protecting Your Data
Our Privacy Policy can be found on our website and sets out our obligations to protect your personal information. Your name and contact information shall only be subject to disclosure as required by applicable law. If we are requested to furnish such information in connection with legal or regulatory process, we will use best efforts to notify you and give you an opportunity to prevent such disclosure.
XI. Intellectual Property
We are proud of the ReBalance products we have developed and the efforts we have undertaken to reduce and/or offset carbon emissions. We consider our ReBalance products to be proprietary and we retain all intellectual property rights connected with them such as copyright, trademark, and moral rights.
XII. Miscellaneous
Authority. You are 18 or older and have the legal authority to subscribe to ReBalance products.
Changes. Clean energy projects are in heavy demand worldwide; at the same time, they are in short supply. The nature of the clean energy projects we invest in as well as their availability and price will likely change over time. Accordingly, from time to time we may notify you about changes in these terms and conditions. We will alert you to any such changes as soon as we become aware of them, and we will give you a reasonable time to tell us whether you wish to continue your subscription with the changes or terminate it without penalty as described above.
Delays. In the event of a shortage of carbon offsets, we will notify you so that you can decide whether to terminate your subscription or stick with us until we line up suitable offsets that meet our standards.
Governing Law; Disputes. Your subscription is governed by New York law. Any disputes shall be settled by arbitration administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures and in accordance with the Expedited Procedures in those rules. Judgment on an award may be entered in any court having jurisdiction. The parties expressly waive a right to trial by jury and consent to the entry of an award by the arbitrators. This agreement supersedes all prior agreements or representations, written or oral.
